Rule of law ideas unit one.
Rule of law impacts groups of people. This would promote law and order because you are putting value into protecting people from the dangers within society. Another way this would promote law and order so that way people can feel safe. This would promote law and order because it is important.
R v K.G.K back in July in 2016 the supreme court of Canada decided an appeal that is important Jordan found rules of how long a court trial should be. Depending on the type of trial it is but the rules have changed and this would be called transitional cases. Back in 2013 KGK was charged with sexual assault with a child the trial judge took nine months to decided the case and the judge found KGK guilty. The judge who was dealing with KGK requested for him to stay, the judge decided that the time should not be counted. The majority agreed and all the judges of the supreme court felt like it takes time to make decisions. The majority made a different approach that will change things so they decided that the judges should only take the time that is necessary and deal with the defendant. The 2nd case with rule of law freedom of expression to be able to say what you believe in and express yourself. Without the government getting involved as long as the person isn’t saying hate speech it is okay and there won’t be consequences. Everyone has a right to a fair trial and a right to a lawyer and that women have a right to be the senate. Back in 1929 in England and then supreme court of Canada when the judiciary to be the privy council the person case Edwards v Canada.
No one is above the law, it does not matter if you have a higher position. Everyone needs to follow the law and respect the laws that have been decided. There are civil laws which are private in Quebec. The judges make a decision about the defendant and it is a rule to be followed in those other cases. There is common law and it is used for private law cases and it is Canadian. These legal principles come from the Magna Carter and were included in the charter rights and freedoms. Someone who gets arrested stays in police custody and they must have a bail hearing. The judge must give the person bail to be released to be free. If the crown feels like the lawyer can show proof that the bail should be denied for a lawful reason. Example : A person does something wrong and the crown decides to deny the bail.
It is important because no one should be above the law. Rule of law has its benefits where you are making an impact in the world. Rule of law is important because you are following the rules and expectations of a society. Why this is important is because the rule of law does many things for people it does more good than harm. Rule of law has good intentions and if there wasn’t rule of law people would be committing crimes and not caring what they are doing to others. People need to be held responsible when they break laws and the connection I can make is that rule of law is important in the world that we live in today.
2nd idea/concept Classifying cc offenses
The criminal code will list all criminal offenses and there are procedures police officers need to follow. The criminal code gets rid of the death penalty and there are summary offenses where two people get into a physical fight and verbal offenses which are hybrid. It is basically less serious offenses where you would pay money or spend a couple of months in jail. To be able to charge someone the police officers have to see you doing that crime. The more serious offenses where you get life in prison or even up to 2 years. A judge can decide the case or a jury can make the decision. Jail time can increase to 18 months and most crimes in the criminal code are hybrid offenses. There is murder and hate speech. Doctors can assist someone to death and help them die with the patient's consent and make bullying a crime. Example : A guy killed a pregnant woman so he murdered a victim.
The first question I have is the rule of law in every country and city? The 2nd question I have is why do some people in the law enforcement take advantage of their higher position? The third question I have is why do some court trials take so long?

This would impact the wider community. This would promote law and order because cc offenses matter. Another way it would promote law is because the law would be applied if someone commits a serious crime. That would have a huge impact on people in a large community and the connection I can make is law and order would protect laws that the government has made. It keeps the idea of law and order which is important.
It is important because the criminal code matters because you are putting criminals away for committing a crime. If someone commits a serious crime they should go to prison for it and it is important people need to feel safe and protected and feel like they are being protected by the law and it is important because the police need to be aware of someone doing that crime so the police need to see you. To make those charges is important because some criminals that are guilty are dangerous and these crimes need to be taken seriously. It is mostly important because the criminal code is also meant to do good, like getting rid of the death penalty and making anyone who is a bully go to jail depending on what they do to others.
The first question I have is why would you want to cause serious harm to someone else? My 2nd question is can someone get away with doing a summary offense? My third question is do people respect law and order all the time? My fourth question is what consequences will there be for not following a specific procedure?
A woman got sexually assaulted by a guy and he left at 4;00 PM. This happened in a bedroom and the woman went to police to report what the guy did to her. The women took the guy to court and went to the highest level of court to the supreme court. The woman was hurt and the woman was nervous to go to the police station. The 2nd case to do with this concept is assault that is aggravated causing harm to that other person and causing life threatening injuries. Or trying to make that person disfigured and make that person feel bad and trying to scare them. With hybrid offenses the crown has to decide how serious that crime was and how serious the injuries were to make any final decisions. The lawyer can play a huge role in whether it is summary or indictable offenses and then can make any decision.
Unit two
: Principles of fundamental justice
Everyone should be treated fairly and that law should be influenced by anyone who has power or money. When you are in court it needs to be fair and everyone has a right to a fair trial and there should not be bias used in a court trial. Judges should treat everyone with respect. A choice being made in court should be based on objective criteria and must have respect for the law. Everyone has equal protection under the law, individuals and government have the same laws. It is important that people are treated innocent until proven guilty because a lot of people get convicted when they didn’t do anything wrong and go to prison and this principle is the most important principle. They have to be proven guilty by the lawyer in court. A person needs the evidence being used against them in court of law and to be prepared for the defense to these charges. The accused needs to understand the proceedings in order to go to trial and bias or prejudice should not play a role in creating laws or the arrest
procedures that police officers need to follow.
**Example
:** Someone getting arrested when they didn’t do anything because someone assumed that person was guilty.
This would promote law and order because the principles of justice are important. This would promote law and order because the law will always come first and fundamental justice has its ways of dealing with the justice system. This would promote law and order because there are certain producers that need to be followed and the connection I can make is law and order is something that will create changes that is meant to keep people safe and there is law and order to maintain laws and laws are always changing. This would impact the wider community because this is about the important principles of justice for example innocence until proven guilty. Another way this would impact the wider community is because of the principles which would apply to everyone because everyone needs to follow these principles including myself.
This is important because the principles of justice need to be respected, especially the one that is for innocence until proven guilty. This principle is important because not everyone is guilty of committing a crime and they deserve to be treated as innocent and the other one that is important is not to use bias because if you have bias then you are making good judgements because of developing your own negative opinion. These principles help certain things going on in the world right now and help things get better and these principles help to create accountability and responsibility in a sense that everyone is responsible enough to obey the law and if they don’t there are consequences that should hold everyone responsible.
The first current issue is violent crimes against other people and there is criminal harassment and the purpose of obtaining and communicating information is to recognize and protect. The person has to have intent to do something or plan on committing a crime for an act to become a crime and go to court. With having harmful behavior which could lead to many different things that can make the world different and peoples life would be at risk. To release someone or to detain someone and there are rights that people have that should be respected and principles of justice should always be considered and someone not being treated fairly can have an impact on people and not giving them a fair trial is not fair. The 2nd issue going on with principles of justice is income inequality where people are not getting paid as well as others since the pandemic and it is leading to poverty situations. There needs to be more opportunities and people need more money and people need to be treated equally. No matter your race, religion or your beliefs and rule of law people take advantage in a way that’s them trying to gain power and control when they are in a higher position than others. Police officers thinking they can get away with certain things so they kill people on the job and try to cover it up and try to get the other police officers to follow the plan. With this 2nd issue innocent people are dying and the police officers are using their authority to get what they want.
My first question is why are people so quick to judge others and assume the worst? My 2nd question is why do some judges use bias or prejudice? My third question is why do some people ignore the principles? Emmaline Soken-Huberty 15 social justice issues we must address February 1st 2022
Access to justice
It is hard to have access to justice and paying for a lawyer is a lot of money. It would cost someone a lot just to have someone to represent your case. Having access to justice there are a lot of steps so if you wanted to get custody of your child away from the father that is maybe causing harm to your kid. Access to justice there is legal aid which is needed if you want legal assistance. There is a lawyer information center where you need to pay before and after the case is closed and you need to wait until you have the payment to be able to pay the lawyer you hired. It is not easy as some think it is to find a lawyer to represent you and you have to explain the details of what happened to you. There are lots of steps to the process of a jury hearing your case and putting the evidence together and to avoid going to court you have to get the person you are trying to divorce to come to the meeting. Example : Trying to leave your husband because you are not happy anymore and want to take the kids but the husband won’t let you see the kids.
This would promote law and order because access to justice and there is ministry of lawyers. This would promote law and order because there are big differences between people having access to justice and some people not having the resources to find a lawyer. This would promote law and order because access to justice law and order is super important. This allows people to have their own ideas and protect what needs to be protected. This would impact the wider community because everyone needs that access to have justice. Another way this would impact the wider community is because this is about justice so that wouldn’t just apply to one person and with access to justice there are certain things that need to be talked about.
This is important because access to justice is important. People need to feel like they can get justice. A connection I can make is access to justice. I think the reason why access to justice is hard is because there is a lot that goes into finding help when someone does something to you. This is important because everyone should feel safe and feel like they can have protection when needed and have that law assistance. This is important because having access to justice everyone needs that but not everyone can afford a lawyer so they should make things easier for finding law assistance.
The first issue is that people feel like there is no honesty to help Canadians with understanding. There is faith around access to justice and there are legal aid issues and technology can help some issues but not all issues. Justice Canada is the main topic in these current issues with not everyone having equal access to justice. The issue is people can’t afford a lawyer and don’t know what to do and this is causing a lot of stress. The issue is that people are trying to figure out how legal aid works and people need more access to justice. People want more resources and want more funding programs and the connection I can make is not having enough money for certain things. The 2nd issue is changing certain things with the justice system and people want to advocate for themselves because it is important to speak up for yourself. There are certain limits to having access to justice and having lawyers.
