Types of Duress
Unlawful Act Duress

A contract may be voidable for duress of goods just as a payment actually made can be recovered if made under duress of goods
The Siboen & the Sibotre [1976] (A person coerced into a contract by a threat against property (e.g. house burn down) may claim duress)

Economic Duress
This is when one party's improper conduct (i.e. civil wrong) causes the other party's fear of economic hardship = duress

New test: (I) Illegitimate pressure, (II) ‘sine qua non’, and (III) ‘reasonable alternative choice’
Lawful Act Duress
These are threats which are lawful, but nonetheless are illegitimate and amount to duress.

Bars to rescission
(1) Affirmation: V can (by word or action) explicitly or implicitly confirm their intention that the contract is enforceable

This is a vitiating factor which makes a contract voidable, so the Injured party can rescind (escape) the contract
