Legislation and National initiatives are (L&NI) focused on promoting and protecting the rights and needs of the individual
The values of care (VOC) embed person-centred practice and ways of working to meet individual needs
Promoting equality & diversity; maintaining confidentiality; promoting individual rights & beliefs
This allows HSC&CC settings to say what is important to them, gives them more control & improves their quality of life
Staff selection & interview procedures must comply with the Equality Act.
The provisions of the EA impact on the way that staff are selected and interviewed- e.g. the advertisement must not state requirements that discriminate against certain groups such as women
Questions asked at interview must not be discriminatory, they must be the same for all candidates and cannot be personal
Asking the same questions gives everyone a fair chance
The interview panel should be trained in equality and diversity to avoid bias or discriminatory practice
The interview must take place somewhere accessible with facilities for all candidates, including those with a disability
Candidates should be selected on merit- not on lack of mobility to ensure equality of opportunity for all candidates

t. How a carer encourages an individual to make informed choices and decisions so they can take control over their own life
Care settings implement legislation and initiatives such as the Care Certificate and carers applying the VOC will empower individuals to make informed choices and decisions for themselves
Accessible services
According to the Equality Act, reasonable adaptations have to be made to HSC&CC environments to accommodate disabilities whether these are physical, mental, sensory so that the setting is accessible for all
E.g. information can be provided in Braille for individuals with visual impairments and Picture Exchange Communication Systems (PECS) used with children with learning disabilities
Ramps, automatic doors, lifts could be used for those with mobility issues or if children are in a pushchair
Provide a system of redress
.Each piece of legislation outlines the rights individuals are entitled to
If those rights are breached, then the law can be enforced by taking legal action through the courts so that individuals have their rights restored or the person/organisation are penalised, e.g. with a fine or imprisonment
Clear guidelines for practitioners to follow.
E.g the Mental Capacity Act makes it clear who can take decisions, when they should take decisions and how they should go about it
The Data Protection Act provides detailed regulations about how to handle information about individual HSC&CC environments
The Care Certificate has 15 standards against which a H or SC worker is assessed
Completing the Care Certificate demonstrates that the care worker knows exactly how to carry their work out to the highest standard
