Actus Reus and Mens Rea
-
Actus Reus
-
Causation
-
Thin skull rule
-
If the victim has something unusual about them that makes an injury more serious, the defendant is liable for the more serious injury.
The chain of causation
The prosecution must prove that there is legal causation in order to prevent convicting an innocent person
The link between the act and the consequence must remain unbroken for there to be criminal liability
-
-
Mens rea
Intention
-
In most cases, the intention is clear, known as direct intent
-
-
Transferred malice
Someone can be guilty of an offence if he intended to commit a similar crime but against a different victim
Each offence has its own mens rea, except offences of strict liability which do not require proof of mental element in at least part of the actus reus
