In this letter I will cover what damages you can claim for, legal advice, alternative dispute resolutions (ADR) and settling your dispute in court.
Damages
1- There are two types of losses that you can claim compensation for.
Pecuniary losses is financial losses ie loss of wages from not being able to work
Non-pecuniary losses is non financial losses ie the injury itself, pain, discomfort, mental distress, loss of amenity (enjoyment because of not being able to do hobbies)
2- The losses you have suffered will determine what types of damages you get
Special damages are used to compensate fixed pecuniary losses already suffered before the claim comes to court.
General damages are used to compensate future pecuniary losses and non-pecuniary losses.
Damages can be paid by the defendant through a lump sum or through periodical payments.
A lump sum payment is a one time large payment. -Typically used when D has money/ when D is a company. Used for pecuniary losses as they are fixed.
Periodical payments is when the compensation is paid in instalments. -Used when damages are a lot, used for general damages and can be amended by the court.
Other considerations

Contributory negligence
A claimant has a duty to keep his losses to a minimum and any contribution you made to your injury may reduce the compensation awarded.

Inexperienced will not affect the level of care expected. Therefore the actions of an inexperienced defendant will not be compared to those of a reasonably competent person.

Smith v Leech Brain
If the type of damage is foreseeable then a defendant is liable even if the damage is more severe because of the claimants hidden vulnerabilities.

Pros
It makes sure that defendants (especially companies) take adequate care over health and safety because they will be responsible for most injuries that happen.
We hold people to account for only predictable damage. This seems fair as if you’re negligent then you should only be responsible for predictable consequences
Cons
It can be quite unfair when the damage seems like it’s totally disconnected from their negligence.
Ie In Leech Brain not even Mr Smith was aware of the dormant cancer cells!
It means that a person can sue you for damage that you might expect but that becomes unexpectedly serious later.
