Suspect must be cautioned at the time of their arrest unless their behaviour or condition means it isn't practical to do so (Code G)
Equality Ac 2010 makes it unlawful for police to discriminate against, victimise or harass those with protected characteristics.
SUMMARY
-
Typically occurs when a police officer believes there's a probable cause that the individual has committed, is committing, or is about to commit a crime.
Reasons for arrest include suspicion of criminal activity such as theft, drug offenses, assault or driving under the influence.
Purpose of arrest is to bring the individual before a court to face charges and ensure the administration of justice.
SECTION 24
-
Constable may arrest someone if they are about to commit, are committing, or have committed an offence, or if there are reasonable grounds to suspect such actions.
The arrest must be deemed necessary for reasons such as verifying the person's identity, preventing harm, protecting property, ensuring public decency, or facilitating a prompt investigation.
Both involvement in a criminal offence and reasonable grounds for believing the arrest is necessary must be satisfied.
