There are amendments in the constitution that state that this is unconstitutional and that it should continue to be protected by the law and not left up to the decision of the states
Think that since women were not considered equal when the constitution was made and didn't have the choice in the political process so we should be able to consider the context and infer due to women and minorities not being considered
Human rights would be granted at the point of viability and as our technology progresses that changes and it is estimated at 28 weeks (R v. W) but it also could be earlier
There should be a ban on any kind of abortion that causes pain to the fetus so its important to know the time period where the fetus can start to feel pain (around 22-25 weeks but has been found as early as 12)
Relates to the different policies to each state like DC who has no ban at all while there are 13 that have total bans on abortion

Really value the concept of reserved powers; in D v. J do not allow the states from regulating or prohibiting abortion because in when they are looking at the history that if it is established on a federal level then there is less nuance on a state level

It is challenging to know exactly when the fetus can feel pain and when they would have rights bit some professional can decide off of their own opinions but in the third trimester it should be allowed in emergencies where the fetus could die after birth, it could be life threatening to the mother or not being able to receive treatment due to the pregnancy
If Kamala wins she wants to reinstate a federal abortion law due to people having to travel to get abortions which is unsafe
