Contractual right gives right to equitable right to land. once parties sign land contract, When parties sign land contract, equitable right to land also created. Parties have in personam claims against each other in respect of obligation under the contract.
Lord Keith of Kinkel: NLC is complete and comprehensive code of law. Governing landa matters including tenure of land in MY therefore no room to import English Law rules except code itself expressly allow for that.
This case was before NLC enacted, thus Selangor Registration of Titles Regulation 1891 is the governing law at that time. s4(i) of the regulation declared null and void any dealings outside of the statute.
