        All activities of the Appellate Body are currently suspended due to an insufficient number of members to review appeals. Under Article 17.1 of the Understanding on Rules and Procedures Governing the Settlement of Disputes (DSU), a quorum of three members is required to establish a division for appeal hearings. However, on 10 December 2019, the terms of two of the three remaining members, Mr. Ujal Singh Bhatia and Mr. Thomas R. Graham, expired, leaving only Ms. Hong Zhao, whose term was set to end on 30 November 2020. Despite several 2019 meetings of the Dispute Settlement Body aimed at filling the six vacancies in the Appellate Body, no resolution was reached. Meanwhile, the backlog of complex appeals continued to increase, with Tirkey noting that by the end of 2019, 13 appeals were pending with no indication from WTO headquarters in Geneva regarding how, when, or by whom they would be resolved.
        
        The Appellate Body crisis was initiated by the United States (US), a key architect and one of the most frequent users of the WTO dispute settlement system. Deepak argues that since 2017, the US has been blocking the appointment of all new Appellate Body members due to concerns over judicial activism. Criticisms include the Appellate Body’s frequent (a) breaches of strict timelines for completing appeals; (b) allowance of former members to hear pending appeals; (c) review of panel facts and member states’ municipal law; (d) issuance of advisory opinions; (e) treatment of its reports as binding precedent; and (f) issuance of erroneous interpretations of the covered agreements.
        
        The US has outlined its concerns regarding the Appellate Body at the WTO General Council and various DSB meetings; however, these concerns were detailed comprehensively in the ‘2018 President’s Trade Policy Agenda’ and updated in the ‘2020 Report on the Appellate Body of the World Trade Organization.’ These reports emphasized that, over many years, multiple US administrations had raised issues regarding the Appellate Body’s failure to adhere to fundamental WTO rules. McDougall noted that these concerns intensified following the inauguration of President Donald Trump in January 2017, with the Trump administration’s stance reflecting broader skepticism toward multilateralism and binding dispute settlement, alongside a deep suspicion that global trade rules increasingly disadvantage US interests.

        Effectiveness of the Panels
        
        Disputes brought to the WTO are adjudicated at the first instance by ad hoc dispute settlement panels. This section covers the establishment, composition, mandate of these panels, and the content of their reports.

They are ad hoc bodies established for the purpose of adjudicating a particular dispute and are dissolved once they have accomplished this task. Such a ‘request for the establishment of a panel’, also referred to as a ‘panel request”
        
        “The ‘matter referred to the DSB’ consists of two elements: (1) the specific measure(s) at issue; and (2) the legal basis of the complaint, i.e. the claims of WTO inconsistency.361 The ‘document’ referred to in these standard terms of reference is the panel request. Hence, a specific measure and a claim of WTO inconsistency regarding that measure fall within the panel’s terms of reference, i.e. within the jurisdiction of the panel, only if they are identified, with sufficient precision, in the panel request. A panel is bound by its terms of reference.362 It follows that the complainant cannot, in the course of the panel proceedings, put new measures or new claims before the panel. ”
        
        WTO panel decisions are binding, with an expectation that members comply. The effectiveness of enforcement relies on member cooperation and the structure of compliance mechanisms. If a member fails to implement a ruling, the DSB can authorize trade sanctions or compensation. This system depends on voluntary compliance to an extent, as punitive measures like sanctions may be limited by the complainant’s ability to exert economic pressure. The effectiveness of compliance, therefore, is uneven, as powerful nations may find ways to delay or avoid full compliance more easily than smaller economies
        
        Creates a veneer of legality
        
        does not mean that the United States has no legal obligations with respect to such decisions. The source of the legal obligation is not created by the WTO decision itself but by WTO agreements to which the United States is a signatory. In joining the WTO and the DSU, the United States affirmatively undertook the legal obligation to abide by the DSU, which specifically includes the obligation to abide by the WTO dispute settlement process and comply with WTO decisions.45 This process contemplates that when nations lose a WTO dispute, they have three options: bring the non-conforming measure into compliance, offer compensation, or be subject to trade sanctions.46 By signing the WTO agreements, the United States became legally obliged to follow DSU proscriptions with respect to WTO decisions.47 The United States may choose to ignore this legal obligation, but doing so will put it in breach of its international treaty law obligations. It is not the case, as is implied by the USTR’s statement, that the United States can disregard WTO decisions that rule against the United States with complete legal impunity. Additionally, contrary to the Trump Administration’s assertions, the United States is not free to disregard any WTO decision it disagrees with; the United States ignores its legal obligations under the WTO when it does so. Nevertheless, although based on dubious legal reasoning, the current position set forth by the USTR appears to be that when the United States sees a conflict between a WTO decision and U.S. sovereign interests, the United States will protect its interests and disregard the WTO’s decision. This is a central tenet of U.S. unilateralism.

        Dependency on memeber states for enforcmenet
        
        International organizations (IOs) inherently lack the autonomous enforcement capabilities often present in domestic legal systems. Unlike sovereign governments, which can deploy police forces or impose penalties to ensure compliance with laws, IOs depend on the cooperation and willingness of their member states to adhere to agreements, implement rulings, and enforce decisions. This reliance introduces vulnerabilities that can undermine the effectiveness and credibility of such organizations. The World Trade Organization (WTO) exemplifies this dependence and its associated challenges.
        
        State Sovereignty
        
        IOs operate within a framework that respects the sovereignty of their member states. While this respect is essential for securing broad membership and cooperation, it also means that compliance with agreements and rulings is voluntary in practice. Member states retain the right to prioritize national interests over collective commitments, which can lead to selective or partial implementation of international obligations. This in turn effects every aspect of the persuit of effectual enforcement stratigies on an international playing field. This isnt so much an issue with trade law so to speak but rather the the limitation of International law in General.
        
        Law of treaties
        
        The WTO agreements are treaties that form part of international law.36 Long ago, the U.S. Supreme Court established that international law is part of the federal law of the United States.37 The U.S. Supreme Court has also long established a distinction between self-executing treaties that have direct effect within the U.S. legal order and non-self-executing treaties that do not have direct effect.38 This language states that the WTO agreements are non-selfexecuting treaties.39 For a non-self-executing treaty to take effect within the U.S. legal order, the United States must pass domestic implementing legislation.40 It is this domestic legislation, which implements the obligations of the treaty, that has legal effect within the United States.41
