Options for DR
ARBITRATION

governed by the AA 1996. dispute is referred to an independent arbitrator. less formal than court. once TP has reached decision, it will be binding.

ADR?
collective term referring to any means of settling disputes OUTSIDE the traditional litigation process.

- negotiation- parties and lawyers discuss possible solutions 2. arbitration and 3. mediation
Nature of ADR
independent TP. It is voluntary, unless court ordered, conditional/ 'without prejudice', meaning if it fails and court proceedings are taken, court will not be made aware of ADR until AFTER judge has dealt with issues of liability and the award of damages. Parties choose process and can withdraw any time before a settlement is reached and do not have to accept proposed solution.
during court proceedings parties complete directions questionnaire and solicitors must confirm they have explained to their client 1. the need to try and settle, 2. options available and 3. possibility of costs sanctions if they refuse to attempt to settle.

MEDIATION
parties agree on an independent TP/ body. Mediator is sent written statements from both parties and discusses case with them on a 'without prejudice' basis. Supposed to try help parties move towards a resolution.
