Definition: A trust is a fiduciary relationship where the trustee holds legal title to property with a duty to manage, invest, safeguard, and administer the trust assets and income for the benefit of designated beneficiaries, who hold equitable title

Charitable Trusts

Cy pres Applies
when designed charity not in existence at settlor's death, court may redirect the trust to a purpose as near as possible to a charitable endeavor designated by the settlor

if charitable trust cannot perform as intended and the requirements for cy pres are not met, charitable trust terminates and a resulting trust in favor of the settlor's estate results
