Introduction
Meaning:
A contract of sale is a agreement between a seller and buyer, where the seller transfers or agrees to transfer goods for a specific price.
Section 3 of the SOGA 1957 states that Contracts Act 1950's provisions will apply to all goods sales contracts unless they conflict with SOGA 1957's express provisions.

Sale by Sample
S. 17(1) SOGA:
- A contract of sale is a contract for sale by sample, with either express or implied terms indicating the sale.
S. 17(2) SOGA [conditions]
- the bulk shall correspond with the sample in quality
- the buyer shall have a reasonable opportunity to compare the bulk with the sample
- the goods shall be free from any defect rendering them unmerchantable which would not be apparent on reasonable examination of the sample
Sales by Description
Section 15 SOGA states that occurs when a buyer buys goods without seeing them, with an implied condition that the goods match the description.
