5.2. BAIL PROCEDURE
HOLD DEPARTURE ORDER
Issuance of HDO
1 RTC must notify the following:
(1) DFA
(2) DOJ
(3) Bureau of Immigration
Time of issuance Within 24 hours through the fastest available means of transmittal
Cancellation of HDO
1 Judgment of acquittal must include cancellation of HDO
2 Court shall furnish DFA and Bureau of Immigration of a copy of the judgment of acquittal within 24 hours from time of promulgation or issuance through the fastest means available
Precautionary Hold Departure Order
An application to prevent a person suspected of crime to leave PH may be filed with RTC
When issued
- Crimes where the minimum penalty is at least 6 years and 1 day or
- Where the offender is a foreigner regardless of penalty

CANCELLATION OF BAIL
How to cancel bail
- Upon application of the bondman with due notice to the prosecutor -- it may be cancelled upon surrender or death of accused
- Automatic cancellation:
(1) Acquittal
(2) Dismissal of the case
(3) Execution of judgment of conviction
MOTION TO TRAVEL
The accused may seek leave of court to leave PH
- He must show an urgent necessity for his travel abroad, duration of travel, and the conforme of his sureties.
- Whether the accused should be permitted to leave is a matter of the court's discretion
