WHAT IS IT?

CORE
Law binds everyone → Lord Reed - “at the heart of the concept of the rule of law is the idea that society is governed by law” → implies that:

Second and third point aka as government according to law, meaning that government acts as both a restraint to government and as the source of its authority
MIDDLE
Builds on the core meaning by setting out guiding standards for making and enforcing law. Specifies that laws must be made in a certain form and follow a fair process of creation and implementation
WIDE
Requires that the law should offer benefits and protection of fundamental rights and values (democracy, human rights, equality, justice)
The rule of law sets standards for making and enforcing law and protecting fundamental rights and principles; it acts as a protecting mechanism by preventing state officials from acting unfairly, unlawfully, arbitrarily, or oppressively. It also regards as an external measure of what a state does
Is a constitutional value or principle which measures goods governance fair law-making, and applying law in a just way. It is a powerful guiding principle but is not itself a law, and it is not written in a tangible source
Purpose - to keep in check people who govern, prevent the abuse of power, and require that all government action must be authorised by law (Magna Carta idea that rulers were subject to the law)
Theories - can be divided into two -> BUT core idea is that the law is supreme and controls government
FORMAL - Set out the form and procedures that good law-making and the application of law should follow
