Capacity and formalities
capacity and formal validity are necessary pre conditions for the successful formation of a contract but they are not sufficient conditions = they are prerequisites.
example = you must be 17 to hold a driving licence, but that's not enough, you need to pass the test.

capacity = the ability of a person to make a contract, if you lack capacity you cannot contract
formalities
the format or method by which a contract may be made and deals with factors such as the need or lack of need of writing.

Invalidity
if a contract exists, the circumstances in which an agreement has been reached are sometimes taken into account.
examination may reveal either a total absence of agreement/essential validity = void
or even if there was an agreement, the manner in which it was obtained makes it unfair to hold the parties too the contract. = voidable
