In many cases:
- claimant relies on defendant to reveal certain information
- this depends on the type of case - in some, information may be more dense & difficult to understand

Causation
Process of a tort claim:

- Breach of duty established
- (Remaining to establish) causation (prove the defendant's breach cause harm to the claimant)
Purpose:

Two aspects

If either test ('factual' or 'legal') fails, the defendant is able to escape liability

Legal Causation
When 1+ factors are found to have been necessary conditions of the claimant's harm (factual causation)

Negligence:
A breach of a legal duty of care, resulting in damage towards the claimant by the defendant
