Carillion Construction Ltd v Felix: running behind & no other contractors able to complete it on time so demanded more money to complete on time & other party had other contracts dependent on this
Atlas Express v Kafco- where party has no choice but to accept revised terms to detriment of their interest, this will amount to economic duress
B & S Contracts & Design Ltd v Victor Green Publications Ltd- Where V's workmen strike and they demand extra money from D to get work done, if D takes this money off the payment at the end V cannot claim this back as D paid it under duress
Kolmar Group AG v Traxpo Enterprises PVT Ltd- was an agreement to sell methanol at set price and time frame then D gave V last minute take it or leave it proposal of more money for less methanol
Illegitimate pressure
DNSD: Must take into account actual/threatened breach, person exerting pressure acting in good/bad faith, did V protest at the time, did they affirm or seek to rely on the contract

Good/bad faith: DSND- good pressure, suspend work until further indemnities and insurance provided for divers

Protest: North Ocean Shipping Co Ltd v Hyundai Construction Co Ltd & Other- no protest & only made a claim 10 months later

Affirm Contract: B & S Contracts & Design Ltd v Victor Green Publications Ltd- deducting amount they paid under duress from the invoice, refusing contract immediately

Undue Influence
RBS v Etridge- where consent is not expression of their free will. Two types: overt acts of improper pressure (duress overlap) or a relationship of influence/ascendancy which is taken advantage of unfairly
Improper pressure/coercion: deceitful/fraudulent behaviour which uses same test as duress to the person (need not be deciding factor, just a factor) If behaviour is not deceitful/fraudulent then but for test may be needed

Remedy: contract may be set aside but only if contract not affirmed and party claiming has not acted 'under-hand' as those who seek equitable relief must come with clean hands
