Ashcraft v. Tennessee
This case involved E. E. Ashcraft, who was convicted of putting a hit on his wife. John Ware, the person he hired, claimed he was extorted out of a confession, and, as a Black man, feared mobs coming after him. Ashcroft likewise claimed the same, being interrogated for more than 36 hours with only a 5 minute break. In that time, he claimed to have been abused and threatened. So, the argument is, whether or not law enforcement violated a defendant’s right to not self-incriminate. In a 6-3 decision, the Court overturned the convictions and ruled that because of the psychological pressure, even without physical abuse, the confession could be ruled inadmissible in Court.
