Used to describe injuries that affects the mind rather than the body, or physical injury brought on by an effect on the mind

How can you claim?
Claimants who can prove such injury can claim in negligence if they can establish that:
- They are OWED DOC by the defendant
- With regard to psychiatric injury
- The defendant's negligence caused the injury
BUT it will depend on the relationship the the event that caused the shock AND case laws covering different categories of victims
The types of victims since the HoL case of White and others v Chief Constable of South Yorkshire (1998)
Physically injured in the event that defendants has caused, suffering psychiatric injury as a result of it = Primary Victims

Not in danger of physical injury, but suffer psychiatric injury as a result of WITNESSING INJURY TO OTHERS = Secondary Victims
