Basics of Consideration
Definition of Consideration:
- The promisee should not be able to enforce a promise unless he as given/promised something in exchange for that promise, or the promisor has been promised something in return
- Per Lush J: "A valuable consideration may consist either in some right profit/benefits to the one party or some responsibility that has been given, suffered or undertaken by the other".
Thomas v Thomas Per Patterson J: "Something which is of value in the eyes of the law must be given in order to enforce the contract
