Mutual Wills

The crucial aspect of mutual wills is the mutual agreement between the parties that once the will is created, it cannot be revoked except with the consent of the other party.

When two (or more) individuals reach an agreement regarding the distribution of their property through their respective wills. Commonly seen in husband/wife scenario.
Solicitor duties owed

Howe v Fisher [2014] NSWCA 286 held that the solicitor was not negligent for not getting the client to sign an informal will. However, the same case noted that where a solicitor foresees a factor that may 'frustrate' the making of a formal will, the solicitor should draw the client attention to making an informal will.

There is a presumption of due execution when a will has the testators signature and the witnesses signature.
The two witnesses do not need to be in the presence of one another however they must sign in the presence of the testator.

A gift to a beneficiary is void if the beneficiary is a witness. This is defined as an interested witness - Succession Act 2006 (NSW) s10(2)
