- Section 21(8A) states that CCMA may grant the union the right to elect shop stewards and paid time off for shop stewards if the union doesn't have these rights. Or such a union that already enjoys all organisational rights except the right to disclosure of information can be granted the right to disclosure if no other union in that workplace has that right.
- The union that does not meet the threshold in collective agreements may be granted the first three rights in a CCMA arbitration if the union represents a significant interest or a substantial number of employees in the workplace.
