Concept, purpose and types of travel agencies

Travel and Tourism Agencies are commercial enterprises, duly constituted by natural or juridical persons professionally engaged in selling tourism plans.
By reason of the functions to be performed and without prejudice to the freedom of enterprise, Travel Agencies are of three classes, namely:

Legal regulation
The contractual relationship between the organizing agency and the client is governed by the clauses of the package travel contract, by the trip data sheet detailing its final content and by these general conditions, all drafted in accordance with the provisions of the Travel Agency Regulations and by the State Law on General Conditions of Contract.
The contracting parties expressly submit to the jurisdiction of the Courts to resolve any discrepancies or claims arising from the interpretation or execution of the travel contract and the general conditions, and waive their own forum if different.
Tourism contracts
When such a relationship exists, the traveler may require the execution of a contract with the travel agency.
Agencies are required to provide a service contract that establishes the companies' responsibilities and the traveler's obligations. The contract must be complemented with the issuance of an invoice, since the tourist delivers a considerable amount of money.
Among the clauses that must be included in the travel agency contract is the identification of the person in charge of the company and the name of the agency.
The document must state the destination of the trip, the date and the name of the airline that will transport the traveler.
The act of registration for the trip and the consideration of reservation requires that the client has paid a deposit of 40% of the total amount budgeted, unless the economic conditions of the suppliers impose the advanced payment of another amount.
Price of the trip
The price may be revised up to 20 calendar days before the date of departure in the event of variations in the cost of transportation (including the price of fuel), in taxes or fees related to certain services (such as landing, embarkation or disembarkation at ports and airports) and in the exchange rates applied to the trip. In the event of a price change, the customer may either accept the supplement or withdraw from the reservation or contract (if the latter has been formalized).
Lodging establishments.
The content and quality of the services provided by tourist accommodation establishments are determined by the local tourist category specified in the contract or in the technical data sheet.
