Pleading Stage
Order of pleadings:
- Complaint: plaintiffs first pleading that states grounds for federal subject matter jurisdiction and shows plaintiff is entitled to relief - includes demands for relief
- Answer: defendants first pleading which responds to factual allegations and asserts defenses/ counterclaims

- Pre-Answer Motions: filed before an answer and asserts motions to dismiss or amend complaint

Pleadings: a paper containing factual assertions and allegations that support jurisdiction and legal claims in a civil suit

Care and Candor in Pleadings (Rule 11): sets the standard for care in pleadings and provides sanctions for violations of the standard
Rule 11 certifies that to the best of the person's knowledge, information, and belief:
- a pleading is not being presented for any improper purpose
- claims are warranted by existing law or for extending/ modifying existing law or for establishing new law
- factual connections have evidentiary support or will likely have evidentiary support after discovery
- denial of factual contentions are reasonably based on belief or a lack of information
Rule 11 Summary: a pleading has has to be reasonable, warranted by existing law or a good faith argument for its change, and have a proper purpose
