The civil courts:
-
-
Examples:
-
- Personal injury cases, such as road traffic accidents, accidents at work, and slips, trips and falls.
- Clinical negligence and other forms of professional negligence (where the courts deem a duty of care to arise)
- Breach of contract or promise, such as cases where money is unpaid, or a contract is not properly complied with.
- Employment law, for example where an employee suffers discrimination.
- Family disputes, such as divorce, dissolution of civil partnerships, children’s issues and childcare arrangements.
Civil and criminal liability:
It is possible for a defendant to be subject to both criminal and civil proceedings arising from the same incident.
Imagine the defendant was driving dangerously and caused someone serious personal injury. The defendant could be prosecuted by the CPS for careless driving. It would also be possible for the victim to bring a civil claim against the driver for damages for personal injury.
