CHAPTER V: LAND ACQUISITION
Compulsory acquisition process
Reply by the LO about his acceptance/rejection of the offered price
accepts - LB will pay the LO win 30 days from execution and delivery of deed of transfer
rejects - DAR will determine the just compensation through summary admin proceedings
disagrees w/ the decision of the DAR - LO may bring the matter to the regular courts for final determination of just compensation
Taking of immediate possession of the land by the DAR
if the LO receives the corresponding payment
if the LO does not respond to the notice of acquisition
Notice by the DAR to the LO about the compulsory acquisition and the price offer, through the ff means:
posting of the notice in a conspicous place in the brgy hall & municipal hall where the land is located
personal notice/registered mail; and
Request by the DAR to the RD to issue a TCT to the RP
Identification by the DAR of the land, landowner and beneficiary
Distribution of the land to the qualified beneficiaries
2 notices are reqd for validity of implementation

provincial office of the DAR generates
list of the lands for wc notices of coverage had already been issued and served
list of landholdings grouped acdg to the prioritized phasing
municipal agrarian reform officer & brgy agrarian reform committee
screens and selects qualified beneficiaries; included qualified beneficiaries in a master list
prepares a prelim list of potential qualified beneficiaries
municipal agrarian reform officer continues w/ the process of land acquisition and distribution
LO if issued a notice of coverage on his land
afforded an opp to exercise his right of retention
provincial agrarian reform officer conducts land surveys; municipal agrarian reform officer, brgy agrarian reform committee member & LB rep conduct field investgations
LB determined the initial valuation of the covered landholding
