By-laws and house rules
By-laws
By-laws are regulations pertaining towards the maintenance, management and use of parcels and common property
Also known as Compulsory/Prescribed by-laws, cannot be amended or repeated
Binds the developer, MC, sub MCs, SPs, lessees and occupiers of the strata lots

House rules
Till the house rules have been passed as additional by-laws in a general meeting, it will have a contractual binding effect on the SPs only

Before MC formation, the residents must obey the House Rules set by the developer which will serve the same purpose as the prescribed by-laws
Management Fund, Sinking Fund & Special Levy
Management Fund
Calculation of management fund
- Find the Grand Total from the table given
- Calculate total share values if not given
- Find average per share value per month by (Grand total /Share value) / ( the month stated)
- Using the calculated average per share value per month to find management fund for each respective share value

Sinking Fund
Calculation of Sinking Fund
- Calculate annual sinking fund by dividing estimated full cost from estimated full life span ( Annual sinking fund/ estimated full life span
- Calculate grand total of annual sinking fund
- Calculate total share values if not given
- Find average per share value per month by (Grand total /Share value) / ( the month stated)
- Using the calculated average per share value per month to find management fund for each respective share value
Insurance
Workmen’s Compensation Policy
- Workmen’s Compensation Act (MOM), cover all workers employed by MC regardless of salary
Damage/ Fire Policy
- Most important of all insurance, mandatory under the BMSMA
- Subdivided building must be insured unless directed by a Resolution by Consensus.
SUBDIVIDED BUILDING includes:
- SP’s improvement & built-in fixtures which form part of subdivided building
- Bath, sinks, stoves and kitchen cabinets (paint, wallpapers & temporary walls, floor & ceiling covering should not be included)
- A building consisting entirely of common property (such as outdoor tennis club)
- Anything else which is prescribed as forming part of a building (covers wide range of calamities such as lightning, explosion, flood, etc. and/or any damages recommended to be specified by all SPs)
2 TYPES OF FIRE POLICYTrue Damaged Policy
- Repair, restore or replace of the damaged portion of the subdivided building to original condition in the event that it is destroyed/damaged by fire, lightning, explosion or any other occurrence specified in the policy
Limited Liability Damaged Policy
- Liability of insurer is limited to the amount insured decided by MC in the insurance policy; increased building cost, removal of debris & professional fees for re-rebuilding work are taken into account
Purpose
To avoid disputes with insurer on replacement values of units in event of damage/destruction, SPs encouraged to submit a list of improvements made in their units to MCST for record-keeping
• To ensure equitability, SPs that do so are likely to incur a higher insurance premium than other SPs that did not make improvements
• Ought to include clauses on loss of rental income or expenses incurred during building re-construction stage
• Common exclusion: damage caused by leakage of sprinklers (MCST should not neglect this important aspect)
Public Liability Policy
- Against damage to property, death or personal injury occurring on common property
EXAMPLE: visitors to the estate get hurt or injured from falls
- Minimum recommended amount is $1mil for residential estate; $2mil for commercial and industrial building
Error & Omission
- Protect MC against negligence or oversight by council members
- Should be taken to protect against against instances where council members make judgement errors or fail to discharge duties as expected
- Smaller estates: Sum insured = $500,000 ; Larger estates: Sum insured = $1mil
- Covers only genuine mistakes
- Not covered: fraud, acts of defamation, slander, libel by council members, fines imposed by authorities, deliberate omission to cover costs
Other Insurance Policy
- Plate Glass Policy
- Contents (cover loss of personal possession such as carpets, furniture, computers, etc.)
- Medical & Hospitalisation (to protect against unusually high medical costs)
- Cash-In-Transit (For site staff that collect cash payments from SPs & residents)
INSURANCE BY SPs (free choice)
- Home Contents Policy (against theft or burglary)
- Renovation Works (by paying additional premium under MC’s damage policy)
- Personal Liability (against falling window)
INSURANCE BY MA
- MA should carry their own PI insurance (Professional Indemnity Insurance, to protect professional and their businesses in the event of claims made by a client or third party)
- Appointed MA has to take out an individual policy unique to the development with MCST endorsement and non-cancellation clause for protection purpose, through doing so, MCST becomes beneficiary of policy & not MA
- Reasonable sum to be insured: 2 years maintenance fund contributions
- Recommendation: Policy premiums listed separately from MA fee; by doing so, MA would absorb premium if it resigns from the development

- A decision not to insure the buildings in an estate against damage by fire
