If the TF is an independent contractor it is unlikely that the D will be VL for their conduct as they are carrying on their own independent business so the C should sue their directly particularly as they carry their own public liability insurance (Barclays Bank v Various Claimants -).
This is typically an employer/employee relationship (ER/EE) or a relationship that is ‘akin to employment’ (Cox v MOJ; Various Claimants v Catholic Child Welfare Society).
