Sometimes, a party indicates that he does not intend to go on with the contract even before his time for performance has arrived:
e.g., CD Services Ltd enters into a contract with James to engage him as deejay at their nightclub. The contract is due to start on October 1. However, on September 15, James is informed that CD Services Ltd will not be needing his services anymore. James is furious and wants to sue.Here, the breach by CD Services has taken place before they were due to perform the contract, ie. October 1. Such a breach is called an anticipatory breach.
