Pre- Action Protocols
What are they?

They encourage settlements to be reached but if this is not possible they ensure that any court proceedings can be dealt with efficiently and as quickly as possible
Where are they found?

But when it comes to deciding who would pay legal costs, the court will take into account "the conduct of all the parties, including in particular conduct before, as well as during, the proceedings" CPR 44.4(3)
Steps to be taken:
1- LETTER OF CLAIM
Should include "concise details about the claim, the basis for which the claim is made, the summary of the facts, what the claimants wants from the defendant and if the money how much is calculated"
2- DEFENDANTS REPLY
Expected to reply within a reasonable time frame- 14 days in straight forward cases and no more than 3 months in complex ones
The reply should confirm whether the claim is accepted and if not the reasons why, together with an explanation as to which facts and parts of the claim are disputed and whether the defendant is making a counterclaim as well as providing details of the counterclaim

EXPERTS- para 7- parties should try and resolve disputes without expert advice or evidence. If necessary in low value claims, parties should consider using a single expert, jointly instructed by the parties with the costs shared equally
Settlement and ADR- para 8-11 says litigation is a last resort and look towards ADR methods of settlement
