Actus Reus: Omissions
-
The actus reus is the 'doing part' of any crime. It is the physical element of the crime. Actus Reus can be translated to mean guilty act, however, that definition is too simple. The actus reus is all the elements of an offence other than the mental element.

Statutory Duties to Act
As well as the courts, parliament has created a few other specific statutory situations involving omissions. (can only be committed by failing to do something)
Example: S.6 Road Traffic Act 1988 states that it is an offence to fail to provide a specimen of breathe when asked to do so by a police officer.
