Murder
Defined by Judge Coke as "The unlawful killing of a reasonable human being under the kings peace with malice aforethought" (express or implied)
1. Actus Reus

- The killing was of a reasonable creature
"human being" means a living person. Cannot be charged for killing a foetus (A-G Ref No3 1994) as it hasn't taken its own independent breath.
- The killing took place under the Kings peace.

2. Causation
Factual causation- The defendant can only be guilty if the consequences wouldn't have occurred but for D's actions. R v White
Legal causation- D's actions must be more then a minimal cause of the death "de minimus principle"- there must be a slight or trifling link. R v Kimsey
Novus Actus Interveniens- a new operating cause that results in the defendants liability being waived. R v Jordan

Thin skull rule- D must take his victim as he finds them-fully liable for all consequences. R v Blaue
