Public access to corproate information
Under DPA2018, individuals have the right to find out what information the government and other organisations store about them
How the data is being used
Accès persona data relating to themselves
Have incorrect data updated
Have data erased
Stop or restrict the processing of that data
Data portability
In certain circumstances, object to how that data is processed
Individuals also have rights in respect of automated decision making processes and the use of their personal data for profiling
There is not a prescribed form for individuals to complete instead they simply write to the organisation identifying themselves and askf or a copy of the information the organisation holds about them
The organisation must provide a copy of the data they hold about you as soon as possible which in most instances is considered to be within one month
An organisations can take up to three months where the request is particuarly complex but in order to take advantages of this extra time, must inform the individual within one month and provide details of why the additional time is required
An orgnaisation is permitted to withold without explanation some or all of the information if it relates to
The prevention, detection or investigation of a crime
National security or the armed forces
The assessment or collection of tax
Judicial or ministerial appointments
Requests for copies of information an organisation holds on an individual are usually provided free of charge, however a small fee may be charged if there is a lot of information or if it is a complex operation to collate all the information
Right to request details of held by an employer or company
Companies must keep their employees personal data safe, secure and up to date
An employer is permitted to keep certain personal information about their employees without their consent
Name and address
DOB
Sex
Education and qualifications
Work experience
NI number
Tax code
Emergency contact details
Employment history with the orgnaisation
Employment terms and conditions
Any accidents connected with work
Any training taken
Any disciplinary action
Certain additional personal information on an employee constitutes sensitive person data and can only be kept and processed with employees explicit consent. This type of data include
Race and ethnicity
Religion
Political membership or opinions
Gneetics
Trade union membership
Biometrics
Health & medical conditions
Sexual history or orientation
An employee has a right to be told by their employer
What records are kept and how they're used
The confidentiality of the records
How these records can help with their training and development at work
If an employee requests details of the information an employer holds about them, the employer has 30 days to provide a copy of that information
Freefom of Information
The Freedom of Information Act 2000 provides public access to information held by public authorities in two ways
Public authorities are obliged to publish certain information about their activities
Members of the public are entitled to request information from public authorities
The Act covers any recorded information that is held by a public authroity
Any natural person or corporate entity can make a freedom of information request and there is no need to provide any reason for the request or the use the information will be put to
Requesters should direct their requests for information to the public authority they think will hold the information. The public authority that receives the request is responsible for responding
Public authorities can withhold information where disclosure is prohibited under other legislation. Additionally, information need not be provided that is access under other legilsation
A public authority has two separate duties when responding to free of information requests
To tell the applicant where it hold any information falling within the scope of their request
To provide that information
Public authorities have 20 working days to respond to a request
For a request to be valid it must be in writing, include the applicants name and correspondence address and identify the information requested
