What does the takeover by Taliban mean for Afghanistan
This occurred after the president of Afghanistan fled the country in August 2021
Happened after US troops were ordered to return perhaps this bolstered Taliban to to take control of Afghanistan.
No US militants or government present to stand against Taliban
it is a possibility due to the conditions in Afghanistan which could lead to a resurgence of terrorist groups targeting US militants and its allies.
Taliban has declared enforcement of Sharia Laws and uncertainties are on how orthodox the application will be
Chances human rights will be violated leading to heinous crimes, similar to the previous takeover, taking Afghanistan 25years back in the time
What Impact does Taliban’s Sharia law have on the Women/People of Afghanistan?
Women and girls are not allowed to attend school or university
Women have been told not to return to work.
Taliban has told women/girls to stay fully covered in black Hijabs
Ariana Cabin Crew, women who were face of Afghanistan now are told not to return to work by the Taliban.
These women are now in hiding fearing for their future.
The liberty women enjoyed is fading away. The future of Afghan women is bleak. As a little girl from Afghanistan writes “we are imprisoned again”.
Could there be rise in Terror groups leading to gross violation of Human Rights?
Amidst this chaos, the terror groups like Al-Qaida and ISIS will be ready to take advantage of the situation.
Us intelligence state that Taliban still maintains relationship with Al-Qaida.
The terror groups can regroup in Afghanistan.
Leading to mass violations of human rights.
Can the takeover by Taliban be prosecuted by ICC
The ICC in 2017 had commenced investigation in Afghanistan on crimes committed during the previous takeover.
In previous takeover by Taliban there were crimes against humanity and war crimes committed.
The Afghan government relied on Article 18(2) of the Rome Statute.
This request was granted on the principle of complimentary which is allowing the state to prosecute until they are not able to do so.
The takeover itself although illegal cannot be prosecuted but the crimes committed under article 5 of the Rome statute is.
Should ICC intervene now and assist Afghanistan before Mass atrocities
ICC only has jurisdictions to prosecute and lead investigations under the Rome statute.
ICC can only intervene if crimes listed as per Rome statue is committed.
ICC should encompass such takeovers under its jurisdiction.
Is there Hope for Afghanistan
Afghans faced gross violation of human rights during the previous takeover which needs to be addressed by ICC.
ICC should not let Afghanistan rely on article 18(2) of the Rome Statue. .
the gross violation of human rights and war crimes needs to be punished in a manner which must serve as a deterrence. .
Currently, violation of rights has begun and it is only a matter of time that Afghanistan will be faced with further atrocities. From my perspective either ICC recommences investigating or it extends its jurisdiction to encompass Terrorism by classing such takeovers as Terrorism.
This will send a message across that such crimes will not be tolerated and IICL will exercise its jurisdiction to curb such issues.
