A. CRIMINAL LAW AND CIVIL LAW
CRIMINAL LAW
A legal wrong which involved certain kinds of wrong doing as offences against the state.
Purpose
protect people
prevent crime
punish criminal
The punishment for crimes, range from death or imprisonment to a money penalty (fine), whipping. Child offenders will be placed at approved schools or rehabilitation centers
The police are the public servants whose duty is the prevention and detection of crime and the prosecution of offenders before the courts of law.
In criminal proceeding, the prosecutor will prosecute Defendant and the result will be either a conviction and punishment for the defendant or an acquittal.
CIVIL LAW
The law which concerned with the rights and duties of individuals towards each other .
It determines who is right or wrong in a contentious situation and who should pay and be paid compensation for loss or damage.
The purpose of civil law is to provide redress/remedy to the concern parties by claiming damages.
In civil proceeding , the Plaintiff will take action against the Defendant (sues) .
The result is a judgment for the Plaintiff (damages/injunction) or a discharged of Defendant .
