CHAPTER 5 RIGHTS & RESPONSIBILITIES OF EMPLOYEES & EMPLOYERS ACCORDING TO IRA 1967
RIGHTS OF EMPLOYER & EMPLOYEES
RIGHT TO JOIN A UNION
No person shall harass, detain or compel an employee or employer to join a trade union and to participate in its lawful activities.
RIGHT TO PARTICIPATE IN THE FORMATION, ADMINISTRATION & ACTIVITIES OF THE UNION
There is no interference with each other in the trade union in the establishment, function or administration of the union
No assistance or support with the objective to influence or control the trade union
RIGHT TO FORM A UNION
There is no harassment, restraint or coercion of employees or employers to exercise their right to form and assist in the formation of trade unions
(EMPLOYERS PROHIBITED ACTIONS) Section 5 (1) IRA 1967 Section 5: Prohibition on employers and their trade unions in respect of certain acts
No employer or trade union of employers, and no person acting on behalf of an employer or such trade union.
:red_cross: Impose any condition in a contract of employment seeking to restrain the right of a person who is a party to the contract to join a trade union, or to continue his membership in a trade union.
:red_cross: Persuade a person to desist from joining or ceasing to be a member or officer of a trade union by conferring or offering to confer any benefit on or obtaining or offering to acquire any benefit for any person
:red_cross: Refuse to employ any person on the ground that he is or is not a member or an officer of a trade union
:red_cross: Discriminate against any person in regard to employment, promotion, any condition of employment or working conditions on the ground that he is or is not a member or officer of a trade union
:red_cross: Fire or threaten to dismiss a worker in his or her job because the worker is or plans to become a member or officer of a trade union or participates in the promotion, formation, or activities of a trade union.
:forbidden: Persuade a workman of the employer to join or refrain from joining a trade union at the employer's place during working hours
:forbidden: Intimidate any person to become or refrain from becoming or to cease to be a member of a trade union
:forbidden: Induce any person to refrain from becoming or cease to be a member of trade union by conferring or offering to confer on any person
