Identifying and Aiding Students With Learning Disabilities In Accordance With the Individuals With Disabilities Education Act

Phase One: Recognition
Teachers should be constantly evaluating students' behavior and needs. While all students have needs, some of those needs can be solved easily in the classroom, while some students have a recurring need that may be the indication of a learning disability.
Phase 2: Pre-referral
In this phase a team of teachers and other professionals seek to implement more targeted learning strategies designed for the student to be successful in learning without the need for special eduction services.
Phase 3: Referral for Special Education Services
If the interventions staged in phase 2 have not been effective, the school may refer the student for an evaluation to determine suitability to receive special education services. The referral can be requested by school personnel or the student's parent/guardian.
Phase 4: Special Education Evaluation:In accordance with IDEA, the school district must complete the evaluation within 60 days of the referral in the previous step. The evaluation is completed by a team of trained professionals, including:
- Psychologist
- Medical Professionals
- Special Educators
- General Educators
Phase 5: Determination of Eligibility
In this stage the team of experts determine if the student has an IDEA defined disability, and whether or not the student needs access to special education services to access education.
Phase 6: IEP MeetingIf it is found that the student has an IDEA defined learning disability and is eligible for special education services, then an IEP will be created for the student. The IEP will include information such as:
- Student profile, including strengths, weaknesses, and the reason for receiving special education services
- Date of initiation and validity
-Special instruction practices to be utilized
- Goals of the IEP and how progress will be evaluated
Phase 7: IEP Implementation
The IEP team will implement the IEP and ensure its success. This team will meet periodically throughout the school year to discuss the outcomes and make any adjustments that are necessary.
Phase 8: Reevaluation and Continued Observation
Every school year the IEP will be reevaluated and adjusted as necessary.
Not every student who is evaluated will be determined to have an IDEA defined learning disability or deemed in need of access to special education services. If this is the case, the school and parents must put a plan in place to address the needs of students in the classroom and at home.
In this phase and subsequent stages, teachers should be in constant communication with parents. It's possible that the issue can be resolved with a plan of action between parents and teacher to solve the problem. Constantly monitor the students progress for any changes. If the issue is not resolved proceed to phase 2.
