CHAPTER 5: COMPENSATION AND BENEFITS
Legislation Relevant to Working Hours
Maximum working hours are laid down in the Employment Act and the Sabah and Sarawak Labour Ordinances
More than 8 hours per day
More than 48 hours per week
More than 10 hours per day
More than 5 consecutive hours without 30 minutes break
Asians work longer hours than just about everyone else in the world.
South Korea spend more than 45 hours a week on their job.
LEGISLATION RELATING TO
WORKING HOURS
Employer should provide 1 rest day per week.
If employer wants to give more than one rest day, it shouldn't be any problem.
All workers are entitled at least one rest day per week.
The management must inform workers in advance as to the roaster in operation.
Employer should provide 1 rest day to employees,
after they asked to work within 48 hours
Workers who are requested to work on rest day/ agree to their employer's appeal are entitled to premium rates of pay to offset their loss of a day of rest.
Public Holiday
Set by the government.
But, it also depends on the company
according to the state policy.
Minimum Public Holidays
Employment Act = 11
Wether you are in Peninsula M'sia, Sabah or S'wak, you are entitle to get minimu of 10 days.
5/11 must be given to all workers which is National Holiday, M'sia Day, Agong's Birthday, State Sultan's/ Governor's Birthday and Labour Day.
S'wak Lab. Ord. = 16
Those employees working in S'wak, they are entitle to get minimum 16 days. (Depends on the company)
Sabah Lab. Ord. = 14
Those employees working in Sabah, they are entitle to get minimum 14 days. (Depends on the company)
Overtime Work
It cannot be made compulsary except in certain industries (the essential services)
Work done outside the normal hours of work is permitted up to a maximum of 104 hours per month.
Overtime Work
Disadvantages
Higher cost per hour of labour.
May cause dissatisfaction amongst workers.
May cause fatigue which leads to accidents.
Advantages
Provides opportunity for workers to increase their income.
Production or service levels increase without hiring extra workers.
ALTERNATIVE WORKING HOURS SCHEDULING
FLEXITME
It is Flexible.
Is a system of working hours where the starting and stopping times are decided by the individual worker (within a number of limitations set by the employer.
It will give advantage to especially married worker (because they
have to settle down some problem before start working)
Other example, those who working in city, they always face the
traffic jammed.
The most easiest recruitment strategy.
It is productive because it gives more freedom to the employees
to have their own working hours.
Can reduce the overtime cost.
JOB SHARING
2 people or more to
share one job
All the salaries and in terms of benefits will be shared with the number of workers who's sharing their job.
Very suitable for woman who have small
children.
Requires a high level of trust, communication and teamwork btwn the employees who share their job.
PART-TIME WORKING
Depends on whether employees wants
to have temporary or permanent job.
Numbers of working hours should be less than compared to the normal working hours.
Refers to the number of hours, usually calculated
per week, that an employee is required to work
TELEWORKING
Suitable for workers who do not have to travel
to the employers premises to do their job.
Basically they can do their job
from home.
They just have to use their telecommunication
devices so that they can do their work.
Benefits of teleworking
Less travel time & more effective use of work time
Childcare saving
Reduced absenteeism and related to costs.
The relationship btwn the employer and the
employee change radically.
HOME WORKING
It is flexible work scheduling
You are being paid/ doing paid work at home.
For those employees who wants to have more
work life balance, they can do their work from home.
Overtime work
Overtime work must be paid at premium rates
Monthly rated workers are entitled to 1.5 x their hourly rate of pay when they work overtime hours.
Overtime worked on rest day = 2 times the normal hourly rate
Overtime worked on public holiday = 3 times the normal hourly rate
An employee may not be permitted to work more than 12 hours per day inclusive of overtime
