Children's Act 38 of 2005 aims to give effect to certain rights of children as contained in the Constitution
INTRODUCTION
Rights to equality, dignity , life and freedom and security of a person they are for equal protection for all people.

Section 10 of the Constitution of the Republic of South Africa provides for the right to human dignity, the state has to ensure schools safety, sufficient and reliable water and sanitation.
Section 27(1)(b) of the Constitution of the Republic of South Africa provides access to sufficient water the state is required to adopt measures to realise this right.
The right to education provided in the Bill of Right requires access to safe school facilities and quality education.
