Facts:
The plaintiffs in this case are husband and wife who are already old. It was stated in the evidence that the second plaintiff could only read and write in one language which is in Tamil while the first plaintiff, the wife, was illiterate. In the year of 1977, the first defendant came to the plaintiffs’ house to borrow the land title for the requirement of his contract works. As the first plaintiff was reluctant to give the land title to the defendant, she put a condition that the defendant must return the title back within two months after being persuaded by the second plaintiff. After that, the defendant came again and asked the first plaintiff to affix her thumbprint on a document but she did not know the effect. When the plaintiff went to the first defendant' house to ask for the title, he confessed that the land title had been deposited to the second defendant as security for a loan but still promised to return it later. After waiting for another year, the defendant has yet to return the land title. Therefore, the plaintiff sued the first defendant and second defendant, Bank Buruh on the ground that the title was obtained through fraud.
