4) Different Fatwa's based on different situation
Situation 1:
Donator donates his / her organ in the healthy condition
Condition allowed organ donation:
Patient got permission from the donator (verbally or document)
It is be sure that the permission cannot cause of organs traders activity done by the black market syndicet
Patient will die if don't get the organ donation (chose the lesser between two harms)
Organ donation do not affect the donator as to harms, makes disable or handicap, and kills them (donators)
Permission by donator also gain as the donator was adult, mentally healthy, not influenced by someone, not stressed by somebody, or not confused.
Organ Donation cannot occurs in the way of molesting humanity. As existing buy and sell activity beside of organ donation. Must be sure that the permission is just for organ donation only.
Doctors and Medical Practitioner must from the experts who are able to consider the advantage and diadvantage of organ donation towards the desired donator.
Donator were not from contagious disease patient such as hiv positive, covid 19, sifilis, Dahrea and many more
Situation 2:
Donator donates his / her organ in unhealthy condition (analyzed and confirmed by medical doctors that he / she was in short life period)
Organ Donation from dead donator
Condition allowed organ donation:
Death confirmation of the donator before the organ donation & transplant occurs.
Got the permission from the donator since he / she was alive. (verbally / document)
Got the permission from the family of dead donator (verbally / document)
All the condition of healthy donator plus 3 above
2) Dalil Allows Organ Donation
Surah al-Ma'idah (5): 32
'.... whoever saves someone, such saves the whole human...'
Hadith:
لا ضرر ولا ضرار
'Cannot harm yourself and cannot harm the others.'
Usulfiqh method:
'Chose the lesser between two harms or risks'
Surah al-Baqarah (2): 185:
'He (Allah) wants you to be easier and he don't wants you to be difficult..'
