Access To the Law
-
Procedures
If you have to go to court, the procedures can be intimidating and confusing
-
Since you typically have limited knowledge of the law, you may not even be aware that you have certain rights or responsibilities
Language
Without the assistance of an interpreter, you may not understand what is going on during the court hearing
-
If English isn’t your first language, it may be difficult to understand the legal terminology and procedures.
Time
Trials vary in time – Justice delayed is justice denied (if trials drag on then people are not treated fairly)
-
For example - a woman who sued a tobacco company for compensation for terminal cancer – case lasted 9 years
Distance
Living in remote locations can also be difficult. You may have to travel long distances to access your lawyer and visit many times.
This can be costly and timely to arrange, particularly if you don’t have a licence.
There are a range of places you need to go in order to access the law; court house, police, lawyers, offices of lawyers
