ENVIRONMENTAL QUALITY (SCHEDULED WASTE) REGULATIONS 2005
Notification of SW generation
(1) WG shall notify DG of the new categories & quantities of SW generated within 30 days.
(2) Notification under subreg (1) shall include info provided in the 2nd Schedule
Disposal of SW
(1) Disposed at prescribed premises only
(2) SW shall be rendered innocuous prior to disposal, as far as practicable
SW treatment
(1) Treated at prescribed premises or at on-site treatment facilities only
(2) SW residuals shall be treated or disposed of at prescribed premises
Recovery of material or products from SW
(1) Shall be done at prescribed premises or at on-site recovery facilities
(2) Shall be treated or disposed of at a prescribed premises
WG responsibilities
(1) Ensure SW generated are properly stored, treated on-site, recovered on site for material or product from SW or delivered to and received at prescribed premises for treatment, disposal or recovery of material or product from SW.
(2) Ensure SW subjected for movement or transfer be packaged, labelled and transported in accordance with the guidelines prescribed by DG
SW storage
(1) Stored in containers that are compatible, durable, and able to prevent spillage or leakage of SW into the environment
(2) Incompatible SW shall be stored in separate containers and placed in separate secondary containment areas
(3) Containers of SW shall be closed during storage except when it is necessary to add or remove the SW
(4) Storage area shall be designed, constructed and maintained adequately accordance with the guidelines prescribed by DG
(5) SW generated may be stored for 180 days or less
(a) the quantity of SW accumulated on site < 20 metric tonnes
(b) DG may direct WG to send any SW for treatment, disposal or recovery of material/product from the SW up to such quantity as he deems necessary
(6) WG may apply to DG in writing to store > 20 metric tonnes of SW
(7) If DG satisfied of application under subreg (6), DG may grant written approval either with or without conditions
Labelling SW
(1) The date of SW generated, name, address and H/P of WG labelled on SW container
(2) Shall be labelled in accoradance with the type applicable as specified in 3rd Schedule and marked with the SW code specified in 1st Schedule
(3) No person allowed to alter the markings and labels mentioned in subreg (1) and (2)
WG shall keep accurate and up to date inventory in accordance with the 5th schedule for up to 3 years from the date the SW was generated
Info to be provided by WG, contractor and occupier of prescribed premises
(1) Info provided shall be in accordance with 6th schedule or DG shall determine other method as he thinks fit
(2) WG shall complete Part 1 of 6th schedule in 6 copies and hand over he 6 copies to the contractor when the scheduled wastes are delivered to him
(3) Contractor completing Part 2 then hand over 2 copies to WG. After that, WG submit a copy to DG within 30 days from the SW transportation date
(4) Contractor shall deliver the SW to the occupier of prescribed premises within 10 days from the date of receipt and hand over the remaning 4 copies to the the occupier.
(5) The occupier completing Part 3 of the remaining 4 copies. Then retain one copy and return a copy each to the contractor, WG and DG within 20 days from the date of receipt of SW.
(6) WG shall notify DG if he does not receive his copy from occupier within 30 days of SW deliveries to the contarctor.
(7) They shall kept a signed copy of the 6th schedule and retained it for at least 3 years from the date the SW are received by the the occupier of prescribed premises
SW transported outside WG's premises
(1) WG shall provide information in accordance with 7th schedule of each category of SW to be delivered to the contractor along with the schedule upon waste delivery
(2) WG inform contractor the purpose and use of 7th schedule
(3) Contractor shall carry the 7th schedule for each category of SW being transported and shall observe and comply with the instruction
(4) Contractor shall avoid transportation routes that densely populated areas, water catchment areas and other environmentally sensitive areas
(5) Contractor shall ensure that all his employees that involved in the handling, transportation and storage of scheduled waste attend training programme
(6) Contractor shall ensure the employees are well informedof the purpose and use of 7th schedule
Spill or accidental discharge
(1) Contractor shall immediately inform DG
(2) Contractor shall do do everything that is practicable to contain, cleanse or abate the spill or accidental discharge and to recover substances involved
(3) WG shall provide technical expertise and supporting assistance in any clean-up operation (refer subreg (2))
(4) Contractor shall undertake studies to determine the impact of the spillage or accidental discharge on the enviroment over a period of time to be determined by DG
Training
WG shall ensure all employees involved in identification, handling, labelling, transportation, storage and spillage or dischargeresponse of SW attend training programmes
Compounding of offence
(1) Every offence to be done in contrary to these regulations may be compound under sec 45 of the Act
(2) Referred to subreg (1), it shall be in accordance with the procedure prescribed in the EQ (Compounding of Offences) Rules 1978
