spousal testimony privilege: a spouse may not be called as a witness by the prosecution against his spouse in a criminal case and may not be compelled to testify against hist spouse in any criminal proceeding including those were the spouse is not the defendant

Relevance
Definition
Relevant evidence is evidence having any tendency to make the existence of any fact of consequence to the action more probable than it would be without the evidence. (FRE 401)
Legal relevance
Relevant evidence may still be excluded for public policy reasons including legal relevance (FRE 403)
Under 403, a court has the discretion to exclude relevant evidence if its probative value is substantially outweighed by the danger of unfair prejudice; confusion of the issues; misleading the jury; or by consideration of undue delay, waste of time, or needless presentation cumulative evidence
