Why should I care?
• Definition: one which is imposed by law in circumstances where it would be unjust for the party holding legal title to property to enjoy the beneficial interest in it. Pursuant to a constructive trust, the party holding legal title becomes a constructive trustee and must hold it for the benefit of constructive beneficiaries. A constructive trust will always be imposed in cases of fraud and does not require the usual statutory formalities of a trust.
