CHAPTER 7 : SAFETY LAW - Coggle Diagram

- - - - Factories and Machinery Act 1967 has the following disadvantages:
      - ◦Scope is limited to only the manufacturing sector
      - ◦Prescriptive, detailed regulations
      - ◦Too dependent on the government
  - - - Duty of every employer to ensure safety, health and welfare at work of all employees and includes:
        1.Provision and maintenance of safe plant and systems of work.
        2.Ensuring safe and healthy use or operation, handling, storage and transport of plant and substances.
        3.Provision of information, instruction, training and supervision to ensure safety and health at workplace.
        4.Maintenance of safe work conditions and provision and maintenance of access and exit
        .
        5,Provision and maintenance of adequate facilities for employee welfare.
    - - 1.To ensure that machineries or substances supplied are safe and with out health risks when properly used.
        2.To arrange for necessary testing of machineries or substances supplied.
        3.To provide sufficient information and training to ensure the safe use of machineries or substances supplied.
        4.To carry out necessary research to minimize any risk to safety or health at may arise from machineries and substances supplied.
        
        To ensure the safe installation of machineries supplied
    - - 1)Take all reasonable care for safety of himself and others who maybe affected by his acts or omissions at work
        2)Co-operate with employer or other person in discharge of any duty or requirement imposed by act.
        3)Wear or use at all times any protective equipment or clothing provided by employer.
        4)Comply with any instruction or measure on occupational safety and health
        .
    - - 1.To assist in the development of safety and health rules and safe systems of work
        
        2.To review the effectiveness of safety programmes
        
        3.To carry out studies on accident trends or occupational diseases
        
        4.To recommend improvements in work systems and revisions to any practices or policies which prevent work being carried out safely
        
        In addition:
        
        1.Review measures taken to ensure safety and health of persons at place of work
        
        2.Investigate any matter which is not safe or is a risk to health
        
        3.Attempt to resolve any matter regarded unsafe or a risk to health and if unable to do so, to request DG of OSH to undertake inspection.
  - - - Every employer with more than 5 employees is required to prepare and as often as maybe appropriate revise a written statement of his general policy with respect to the safety and health at work of his employees and to bring the statement and any revision of it to the notice of all of his employees.
    - - Employers are required to give appropriate information and training to their workers so that they will know how to work in a safe manner

      - The training may include:
        
        ◦Fire prevention and evacuation drills
        
        ◦First aid including CPR
        
        ◦Electrical hazards
        
        ◦Dangers of working in confined spaces
        
        ◦Safe forklift usage.
  - - - 1.Chance Occurrences
        Accidents that just happen,due to badluck or misadventure and beyond control of anyone and cannot be prevented.
      - 2) Unsafe Conditions
        Conditions that maybe major causes of accidents
      - 3.Unsafe Acts
        Actions by people that are unsafe and that contribute to accidents.
    - - 1) In the event of an accident, employers must inform the DOSH of all accidents, occupational diseases which afflict their workers
      - 2)If the worker is seriously injured that he cannot work for a period of more than four days,
        
        Employer must notify DOSH by the quickest means with a follow-up written report within seven days.
        
        DG of DOSH can then hold an inquiry into the nature and cause of the occurrence.
      - 3.Employers must keep records of all accidents for at least five years
      - 4)A summary of the annual accident records must be sent to the DG of DOSH by the end of January of the next year.
    - - 1.Making inspections of the place of work.
        
        2.Serving improvement notices on employers or other parties who control a place of work.
        
        3.Serving a prohibition notice on employers or other parties who control a place of work.
        
        4.Prosecuting any party who fails to comply with the Act.
        
        5.Fine any party who fails to comply with the Act.
