What makes a consideration valid and enforceable in a promise?
- insufficient consideration = promise had no consideration & therefore, NOT enforceable
- not an element in formation of a contract
- presumed to exist
To what extent does the performance of an existing obligation under a contract, give rise to sufficient consideration? Specifically when the party has an existing duty to the promisor?
