Termination
Employee
An employee may terminate without just cause the employee-employer relationship by serving a written notice on the employer at least one month in advance.
Unlawful Termination
- Re-employ the employee, pay salary, social and health insurances for un- worked days plus at least two-month contractual salary
- If the employer does not want to re-employ the employee and the employee agrees => the parties may agree to terminate the labor contract.
An employee may put an end to the relationship without serving any notice on the employer for any of the following just causes:
- Serious insult by the employer or his representative on the honor and person of the employee
- Inhuman and unbearable treatment accorded the employee by the employer or his representative
- Other causes analogous to any of the foregoing.
Employer
- Definite-term: After 6 months or less than 12 months: over one half of the term of the labor contract
- Indefine-term: After 12 months of treatment
