Types of delegated legislation
An enabling Act is passed to make any of the three types of DL
Orders in Council
Made by the Monarch and Privy Council - allows Government to make laws without Parliament
Statutory Instrument (SI)
Made by specific ministers with authority over the specific matter
By-Law
made by local councils - drinking bans and driving laws
Parliamentary controls on DL
Negative Resolution
Parliament has 40 days to reject the DL
Affirmative resolution
DL will not become Law without Parliament's approval
Questioning
Any minister can be questioned on the DL they have made
What is it?
Parliament gives away power to other body, so that it can make laws
Court control on DL
Ultra Vires
"Beyond its power" - the court can declare the DL ultra vires and can overrule it
