Why do workers join Trade Unions?
To improve their economic situations
To ensure their rights are protected

Trade Unions objective!!
For promoting the industrial, social and intellectual interests of its members
To obtain and maintain for its members just and proper rates of remuneration, security of employment and reasonable hours and condition of work
To promote the material, social and educational welfare of the members
To promote legislation affecting the interests of the members in particular or trade unionists in general
Definition Trade Union!!
The trade Unions Act (Section 2)
Combination of workmen and employers, place of work is in West Malaysia, Sabah or Sarawak whether temporary or permanent
the regulation of relations between workmen and employers for the purposes of promoting good industrial relations between workmen and employers, improving the working conditions or enhancing their economic and social status, or increasing productivity
the representation of either workmen or employers in trade disputes
Membership of a Trade Union!!
Freedom of association and the right is protected in the Industrial Relations Act (Section 5)
An employer cannot prevent an employee from joining the union without stipulating in his employment contract
No employer shall refuse to employ a worker on the grounds he is a trade union member or officer
There is no employer who does not want to hire an employee on the grounds that he is a trade union member or officer
Employers should not be discriminated against in terms of promotion on the grounds he is s trade union member or officer
No worker shall be threatened with dismissal or dismissed if he participates in union activities
Who can join a Union ?
Worker over 18 years
Workman is a person employed by an employer under a contract of employment and the term workman is used in the Trade Unions Act 1959
Employees under 18 years of age shall not be involved in strike activities, imposition of a levy and dissolution of unions or amendment of trade union rules
Members under 21 are not eligible to be elected as officers of the union
Employees who are on leave due to continuing to study by their employer and enroll in a public college or university are eligible to join trade union members
Public sector workers can only join unions formed by workers in the same occupation, department and ministry
Registration of a Trade Union!!
Should the period of one month be insufficient, a request for an extension of up to 6 months can be made to the Director-General
The application for registration must be signed by at least 7 members, which is the minimum number needed to form a union
The application form must be accompanied by the required fees and a printed copy of the rules or constitution of the union
The application must include the name of the unions and its address, the names, addresses and occupations of the members making the application and the names, ages, addresses and occupations of the union’s officers
Director-General will refuse registration in the following
circumstances:
If any of the union’s objectives are unlawful
If any part of the union’s constitution conflicts with the
Trade Unions Act
If the name of the union is undesirable or identical to
another already existing or if the name is deceiving
If the union is likely to be used for unlawful purposes
Trade Union funds
Union members must pay an entrance fee and monthly between RM3 - RM8. Expenses related to salaries for employees of the union
Upkeep of an office
Settlement of a trade dispute
Compensation to members for looses arising out of trade disputes
Allowances to members and their families on account of death, old age, sickness, accident or unemployment
Publishing of a newsletter
Organization of social, sports, educational and charitable activities of the members
Law prohibits unions from using their funds for any political purposes, including providing funds to a political party
Types of Unions!!
Public Sector Union
In 2003 there were 211 unions in this sector
large unions : National Union of the Teaching Profession (104.000 members), Malayan Nurses Union (12,000 members) and the Malayan Technical Services Union (6,000 members)
small unions : the Dental Technician Union with 295 members or the Union of Industrial Relations Officers in the Ministry of Human Resources with 73 members
there are not involved in collective bargaining
2. Private Sector Union
National unions attempt to cover all workers in the same industry, trade or occupation
In house union is an employee who works under the same employer. This immediately suggests that members of such unions can and will be involved in different occupations
In 2003, there were 313 in-house unions : Malaysian Airlines Employees union with more than 7,000 members, the UMW Employees Union with over 2,000 members, Alam Flora Employees Union with 2,200 members and Proton Employees Union with nearly 5,000 members
Yellow unions dependent on the employer. indirectly controlled by the employer, who provides them with financial help, physical facilities, and representatives of management will be involved in running the union
